4 Essential Steps to Dealing with a Residence Permit Rejection
Are you are facing residence permit rejection in Turkey?.
The number of rejections in recent years has been high. This is partly due to the influx of new applications and immigration officers getting stricter as a result. However, most often the rejections are caused by common mistakes in the applications.
In the event of a residence permit rejection in Turkey, you will be given a notification document that outlines the reason you have been rejected. Generally, applicants are given a 10 window to leave the country.
1. Understanding the reason behind your residence permit rejection
Each type of residence permit has different requirements and reasons that may lead to a rejection. For more details on topics related to residence permits, you can find much content on our blog or check out the official Immigration Office website.
Aside from the rejection document, you can also call the official helpline at #157 to get a better idea of what specific reasons led to your application getting rejected.
Generally, the reason for a rejection is based on articles 32 & 33 of Turkish Immigration Law for the following conditions:
- The requirements for the type of residence permit that is requested not being fulfilled
- The applicant having an order of deportation
- The applicant having an entry ban
- Possessing a risk to public health
- Not providing proof of residence address
- Having overstayed a visa in the past
- Applying for a residence permit type that is not suitable for the applicant
- Applying after the visa or visa exemption period is up
2. Appealing a residence permit rejection
The only way to resolve rejections is through the assistance of a lawyer. You can be connected to an experience firm through us, and your lawyers will be able to provide a decent estimate on your chances of success in the following steps.
An important thing to note when you are deciding to appeal a rejection is the time frame of the legal actions you will have to take.
Most importantly, you will need to get power of attorney to a lawyer within the 10 day window that is granted to you to leave the country. Often, residence permit rejection appeals can be conducted by the power of attorney even if the applicant is out of the country.
After a rejection, the applicant legally has 60 days to object to the decision to the Administrative Court. After the appeal process has started – which can take up to several weeks to months – you may be granted permission to return to Turkey.
Keep in mind that overstaying the 10 days allowed may result in bans and penalty fees and eventually may affect your chances of coming back.
3. Overstaying the amount of time allowed
Overstaying your visa or the 10 day period allowed after a rejection can create various issues in your plans to come back to Turkey. If you have been rejected while you still have a valid visa, you will be required to leave before the conclusion of your visa.
4. Reapplying after a residence permit rejection
After you have been rejected for a residence permit, applying again is also an option. Applicants are allowed to submit a new application after 180 days has passed from the date of their previous application rejection of the same type. However, you can also apply for another type of residence permit without the 180 day waiting period.
